  3. hmm... well, you usually have to ask permission of the author do to something like that legally... when i registered my works in congress, the forms would ask if you work was a derivative of another copyrighted work... could try look here for help: www.copyright.umn.edu/home.htm but i look here the most for info: www.loc.gov/copyright/ these interesting: How much of someone else's work can I use without getting permission? Under the fair use doctrine of the U.S. copyright statute, it is permissible to use limited portions of a work including quotes, for purposes such as commentary, criticism, news reporting, and scholarly reports. There are no legal rules permitting the use of a specific number of words, a certain number of musical notes, or percentages of a work. Whether a particular use qualifies as fair use depends on all the circumstances. See Circular 21 and FL 102. www.loc.gov/copyright/circs/circ21.pdf www.loc.gov/copyright/cir...ex.html#fl How much do I have to change in order to claim copyright in someone else's work? Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create a new version of that work. Accordingly, you cannot claim copyright to another's work, no matter how much you change it, unless you have the owner's consent. See Circular 14. How do I get permission to use somebody else's work? You can ask for it. If you know who the copyright owner is, you may contact the owner directly. If you are not certain about the ownership or have other related questions, you may wish to request that the Copyright Office conduct a search of its records for a fee of $75 per hour. Additional information can be found in Circular 22. Could I be sued for using somebody else's work? How about quotes or samples? If you use a copyrighted work without authorization, the owner may be entitled to bring an infringement action against you. There are circumstances under the fair use doctrine where a quote or a sample may be used without permission. However, in cases of doubt, the Copyright Office recommends that permission be obtained. hmm, found this... this good info to know... on us copyright website too... What is a work made for hire? Although the general rule is that the person who creates the work is its author, there is an exception to that principle; the exception is a work made for hire, which is a work prepared by an employee within the scope of his or her employment; or a work specially ordered or commissioned in certain specified circumstances. When a work qualifies as a work made for hire, the employer or commissioning party is considered to be the author. See Circular 9. as am reading throught copyright law... am finding some interest stuff... hmm, seem you can copyright something under a fictitious/stage/pen name too... kewl... you just check the "Pseudonymous" box on the form... well isn't that thoughtful of them... ...well wouldn't ya know it... sonny bonno left a legal legacy... the beat goes on and on i guess... How long does copyright last? The Sonny Bono Copyright Term Extension Act, signed into law on October 27, 1998, amends the provisions concerning duration of copyright protection. Effective immediately, the terms of copyright are generally extended for an additional 20 years. Specific provisions are as follows: * For works created after January 1, 1978, copyright protection will endure for the life of the author plus an additional 70 years. In the case of a joint work, the term lasts for 70 years after the last surviving author’s death. For anonymous and pseudonymous works and works made for hire, the term will be 95 years from the year of first publication or 120 years from the year of creation, whichever expires first; * For works created but not published or registered before January 1, 1978, the term endures for life of the author plus 70 years, but in no case will expire earlier than December 31, 2002. If the work is published before December 31, 2002, the term will not expire before December 31, 2047; * For pre-1978 works still in their original or renewal term of copyright, the total term is extended to 95 years from the date that copyright was originally secured. For further information see Circular 15a. ...oh for the love the god... even this: How do I protect my sighting of Elvis? Copyright law does not protect sightings. However, copyright law will protect your photo (or other depiction) of your sighting of Elvis. Just send it to us with a form VA application and the $30 filing fee. No one can lawfully use your photo of your sighting, although someone else may file his own photo of his sighting. Copyright law protects the original photograph, not the subject of the photograph. ... hope that helps some... maybe a little too much info huh? revery the dreamlost "i got you babe" (sonny and cher) the dream continues...

  7. Stand. 31Dec2002. It’s the difference between: My names is…and I AM! The struggle between: I can’t…and I CAN! Why poison the well? In which you dwell. Drinking the milk Of a faith turned frail. Look in the mirror, No, do not look away Accept that the fire Burns up much, in our day. Idols will break And hero’s will waste Mobs will turn fickle And delights will lose taste. But will you let… the bitter fear win. Drowned in a deluge… of those who won’t swim Or will you stand before the waves Beating all back with confindant gaze. Exclaiming a loud. I exist too! Learning in wonder, who really needs who? revery the dreamlost "porcelain, are you wasting away in your skin" (red hot chili peppers) the dream continues...

  19. Hiya... in the spirit of the Eggnog i'm drinking and all things December related... I invite all to write a Seasonal Poem/Scene/Story... sharing a slice of what this time of year means to you... I.E. X-mas, hannaca(sp?), Quanza, Soltice, 3 kings, Festivous, 'No one else is working so let's go to the movies week', Merrits of Football vs Hockey season and/or the bitter war brewing btw the skiing and snow boarding community at large..., too much pressure? okay... then just write about the brrrrrrrr, cold... To start off, i offer as example my x-mas poem from last year... will try to write another one soon, well if i can ever get that dar williams pagan song out of my head...(taps foot..) Christmastime, Another day, as it is known Takes time to sparkle all it’s own And lonely ones shed tears no more As loved one’s knock upon your door. When calls are made, old friends remember They’re not forgotten in cold December In a rush, no time for thought Hearts are warmed, kind words are bought Sent many miles, with gifts that say I remembered you, will you remember me? As smiles turn inward one can reflect It’s Christmastime, do not forget To wish all well that you hold dear And fill them all with you good cheer… Merry X-mas Yea! well what are you waiting for? have at it ppl... revery the dreamlost "must, get, need, want, now!" the dream continues... 22. hmm, that's always the trouble when i write a song from my head out in poetic form... ya'll can't hear it... the internal meter and flow i usually write into my stand alone poems, just doesn't show so much in the song styled ones... actually, if was more influenced by aimee mann (saw the show the other day in baltimore), pop cliche stuff, and just a hint of anime... hmm, maybe a little too cliche... but hey, i tend do that when writing for others and not myself... ya know i do have something that was supposed to be sorta country... but i can't find it at the moment... i prolly changed it anyway... well if i have any say in the whole thing and have to lean towards anything... it'll be toward the beatles... hey, goals are good things... rev...
